Welcome to NextContract. These Terms of Service ("Terms") govern your use of NextContract.com and our related websites, tools and services (the "Services"). "NextContract," "we" and "us" refer to the company that operates the Services.
By creating an account, requesting or sending a quote, making or accepting a payment, or otherwise using the Services, you agree to these Terms. If you don't agree, please don't use the Services.
If you use the Services for a company or other organization, you confirm that you have authority to bind it to these Terms.
1. About NextContract
NextContract is an online marketplace that connects customers with independent contractors for home and commercial work. We provide tools for finding contractors, messaging, quotes, contracts and payments.
We don't perform the work. Contractors are independent businesses, not our employees. Any agreement for work is between the customer and the contractor, and we aren't a party to it.
We don't guarantee any job, result, price or income.
2. Customer Terms and Contractor Terms
Additional terms apply depending on how you use the Services. They are part of these Terms, so please read the ones that apply to you.
If you hire a contractor through NextContract, the Customer Terms apply to you. If you offer services through NextContract, the Contractor Terms apply to you.
If those terms conflict with these Terms, those terms control on that topic.
3. Eligibility
You must be at least 18 years old and able to enter into a binding agreement to use the Services.
4. Your account
- Keep the information in your account accurate and up to date.
- Keep your login details private. You are responsible for activity under your account.
- Tell us promptly if you think someone has accessed your account without permission.
5. Your content
You may add content to the Services, such as photos, messages, listings, quotes and reviews. You keep ownership of your content.
You give NextContract a non-exclusive license to host, store, display and share your content as needed to operate, improve and promote the Services.
You confirm that you have the right to share your content and that it is accurate and lawful. Public content, such as listings and reviews, can be seen by anyone and may appear in search engines.
6. Payments
Payments through the Services are processed by third-party providers such as Stripe. The Customer Terms and Contractor Terms explain how payments work.
7. Acceptable use
You agree not to:
- Break any law or violate anyone else's rights
- Provide false information or impersonate anyone
- Harass, threaten or abuse others
- Post fake, misleading or paid-for reviews
- Interfere with the security or operation of the Services
- Scrape, copy or reverse engineer the Services
- Use the Services for spam, scams or fraud
8. Intellectual property
The Services, including our name, branding, software, design and text, belong to NextContract or its licensors. You may not copy or use them except as these Terms allow or with our written permission.
9. Third-party services
The Services rely on third parties, such as payment processors, hosting, messaging and mapping providers. We aren't responsible for their products or policies, and your use of them may be subject to their own terms.
10. Electronic communications
You agree that we may send you notices electronically, and that you may sign agreements electronically. Job and payment notices are a required part of using the Services.
11. Privacy
Your use of the Services is also covered by our Privacy Policy, which explains how we collect, use and protect your information.
12. Changes to the Services
We work to keep the Services reliable, but we don't promise they will always be available or free of errors. We may change, add or remove features at any time.
13. Suspension and termination
You may stop using the Services at any time. We may suspend or end your access if you break these Terms, if your conduct creates risk or harm for others or for NextContract, or if the law requires it. Agreements already made, and amounts already owed, continue after an account ends.
14. Disclaimers
The Services are provided "as is" and "as available," to the fullest extent the law allows.
We don't guarantee the quality, safety or legality of any contractor's work, or that a customer or contractor will perform as agreed. A badge, review or verification shows information available when it was checked. It isn't a promise about future work. Please use your own judgment before hiring or accepting a job.
We don't give legal, tax or construction advice. Contract forms and other tools on the Services are provided for convenience and don't replace your own advisors.
15. Limitation of liability
To the fullest extent the law allows, NextContract is not liable for indirect, incidental, special or consequential damages, or for lost profits, data or opportunities.
To the fullest extent the law allows, our total liability for any claim relating to the Services will not exceed the greater of $100 or the fees you paid NextContract in the 12 months before the claim. Some places do not allow these limits, so they may not apply to you.
16. Indemnification
You agree to defend and hold NextContract harmless from claims, damages and expenses that come from your use of the Services, your content, your work or your job, your violation of these Terms, or your violation of the law or anyone else's rights.
17. Governing law and disputes
These Terms are governed by the laws of the State of Texas. Any dispute relating to these Terms or the Services will be brought in the state or federal courts located in Texas, unless the law requires otherwise.
Problems with a job or a payment are handled as described in the Customer Terms and Contractor Terms.
18. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will update the date on this page and may give additional notice. If you keep using the Services after a change takes effect, you accept the updated Terms.
